AbsCrypt provides downloadable software and online services collectively called "AbsCrypt" for protecting confidential information using strong encryption. We do so under these no-nonsense terms, avoiding lengthy legal wording. Legal representatives must interpret the intent and spirit of these terms.
By using AbsCrypt, you confirm that you agree with these Terms of Use. You may be an individual or any form of legally recognized organization.
We reserve the right to change these terms at any time without prior notice. English is the official language of AbsCrypt; any translations are only for convenience and never constitute commitments by AbsCrypt.
2. Services Provided
AbsCrypt performs local and server-based encryption and decryption of files and encryption keys.
3. Encryption Services and Liability Limitation
3.1 Encryption Services
AbsCrypt provides encryption services utilizing industry-standard algorithms, including but not limited to AES-256, RSA, and OTP, as well as our proprietary algorithm, AbsCrypt. Libraries for standard algorithms are sourced from publicly available repositories. The AbsCrypt algorithm, developed by us, is designed to provide a robust level of protection.
3.2 Beta Version Disclaimer
You acknowledge and agree that the AbsCrypt application is in beta version. As such, there may be errors, bugs, or other issues that could potentially lead to data loss or data breaches.
3.3 No Warranty
THE ENCRYPTION SERVICES AND ABSCRYPT APPLICATION ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We make no warranty that the encryption algorithms will be uninterrupted, timely, secure, or error-free.
3.4 Limitation of Liability
a. We shall not be held liable for any security breaches, vulnerabilities, or failures in the encryption algorithms used, including AbsCrypt.
b. In no event shall we be liable for any loss or damage, including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of the AbsCrypt application.
c. By accepting this agreement and using the AbsCrypt application, you assume all risks associated with its use.
d. We are not responsible for any inherent weaknesses that may be discovered in the security technology used.
e. We do not guarantee that you choose a sufficiently strong password.
3.5 Limitation of Damages
You agree that our maximum aggregate liability for any claims under this agreement, regardless of the theory of liability, shall not exceed the total amount of subscription fees paid by you for the AbsCrypt application in the twelve (12) months preceding the claim.
4. AbsCrypt Plans
AbsCrypt provides different types of subscription plans: AbsCrypt Free and AbsCrypt Pro.
4.1 Free
AbsCrypt Free is available for all Windows and macOS users, without cost. The available features in a free version will be displayed in the application.
4.2 Premium
AbsCrypt Pro is available to purchase for all private individuals only. Not ideal for professional use. AbsCrypt Premium provides extended features in addition to the Free plan as specified in the application.
In the case of Premium subscription expiration, you will be downgraded to the Free version.
5. User Responsibilities
a. You are responsible for maintaining the confidentiality of your passwords and for all activities that occur under your account.
b. You are solely responsible for creating and maintaining backups of your data.
c. AbsCrypt is not responsible for any loss or disclosure of information due to your failure to comply with these security precautions.
d. You agree to use AbsCrypt only for purposes that are legal, and never in any way that could cause us legal liability or cause problems for others.
If you are not complying with these Terms of Use, we may suspend or end your paid plan without notice.
6. Personal Information
When you register as an individual, we do not require any personal information from you, except an email address.
See our Privacy Policy for details of what and how we process. Accepting these Terms of Use also means accepting our privacy policy.
7. Updates to AbsCrypt
We may, without prior notice, modify or update AbsCrypt and by continuing to use it you automatically continue to agree to these terms.
8. Payment, Renewal and Refund
We will provide Pro services after receiving payment. Your payment details are never sent to or stored on our servers. Your paid subscription will automatically renew at the end of the subscription period, using the initial payment method. If you want to cancel, you must do so before the end of the current subscription period.
We may change the price of our paid subscriptions at any time, but it will not affect your current subscription period. Price changes will take effect at the start of your next subscription period. You accept the new price by continuing to use your paid subscription after the price change takes effect, or decline it by cancelling before it takes effect.
Cancelling your paid subscription may be done at any time. However, refunds are not offered.
9. Disclosure to Third Parties
We will not disclose any information about you to any third parties without your explicit consent, unless required by law.
10. Disclosure to Authorities and Law Enforcement
a. We will comply with lawful requests from authorities to disclose information. Such information is limited to what we actually possess, which may include statistics, access logs, and encrypted private keys and password manager data.
b. We do not have access to your password or the content of your encrypted information and thus cannot disclose this even if required by law.
c. We believe we cannot be legally compelled to modify AbsCrypt to allow interception of your passwords or information. If such a situation arises, we will use our legal rights to resist and may shut down the service as a last resort.
11. Intellectual Property
The AbsCrypt encryption is a patented encryption method. We exclusively own all right, title, and interest in and to the software and service.
12. Our Responsibilities and Liability
We aim to keep our services available at all times, but are not responsible for unavailability due to issues outside of our control.
We only provide AbsCrypt and are never responsible for any illegal or fraudulent actions taken by others using it. As a user, you are entirely responsible for your actions using AbsCrypt.
Our website may contain links to other websites. Those websites are only provided to be used as a reference and we are not responsible for any content there.
13. Dispute and Validity
These Terms of Use shall be interpreted under English law. Should you wish to take legal action against us, you must do so in a court of law in London, United Kingdom.
The English version of this agreement governs in case of dispute. Any translations are provided for convenience only.
If any part of this agreement is found to be invalid, it does not invalidate any other part of the agreement, and the new interpretation must be as close to the original as allowed.
Technical highest priority and priority email support are provided. We do not guarantee to solve all problems.
By using the AbsCrypt application, you acknowledge that you have read, understood, and agree to be bound by the terms of this agreement.
